These Terms and Conditions apply to the purchase of products and services from Dominator Sports Pty Ltd ABN 46 730 703 046 (“Dominator Sports”, “Dominator”, “we”, “us” or “our”), including purchases made through our website, by email, telephone, quotation or invoice.

By placing an order with Dominator Sports, you (“you”, “your” or the “Customer”) agree to these Terms and Conditions.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

These Terms, our warranty policies, shipping policies and any other Dominator Sports policies operate in addition to your rights under the Australian Consumer Law and do not replace or limit those rights.

If there is any inconsistency between these Terms and a right or remedy that cannot legally be excluded, the applicable law will prevail.

2. Products and Product Information

Dominator Sports supplies basketball hoops, pickleball equipment, sports lighting products, accessories, replacement parts and related sporting products.

We take reasonable care to ensure product descriptions, photographs, dimensions, specifications and other product information are accurate.

Product images are for illustration purposes and minor differences in colour, finish, packaging, dimensions or manufacturing details may occur.

Dominator Sports may make minor or non-material improvements or specification changes to products from time to time.

We will not knowingly substitute a materially different product without advising the Customer.

Customers should review all applicable product specifications, installation instructions, safety information and site requirements before ordering.

3. Pricing and GST

Unless expressly stated otherwise:

  • all Australian website prices are in Australian dollars;
  • prices include GST; and
  • delivery and freight charges are additional unless expressly stated as included.

Prices may change from time to time.

A price change will not affect an accepted order except where there has been a genuine or obvious pricing, system or freight calculation error.

Quotes are valid for the period stated on the quotation.

4. Orders and Acceptance

An order is generally considered accepted once payment has been received and Dominator Sports has confirmed the order.

Dominator Sports may decline or cancel an order where there is a reasonable basis to do so, including:

  • a genuine pricing or system error;
  • inability to supply the product;
  • suspected fraudulent activity;
  • incorrect product availability information; or
  • circumstances that reasonably prevent us from fulfilling the order.

Where Dominator Sports cannot reasonably supply an order that has already been paid for, we will notify the Customer and provide an appropriate refund.

5. Payment

Unless otherwise agreed in writing, payment must be received in full before products are released, collected or dispatched.

Payment may be made using the payment methods made available by Dominator Sports.

Approved dealers, trade customers or commercial customers may operate under separately agreed credit or payment terms.

Ownership of products remains with Dominator Sports until payment for those products has been received in full.

6. Customer Cancellations

Once an order has been placed and payment has been received, the order is considered confirmed.

Dominator Sports does not provide an automatic right to cancel an order because a Customer:

  • changes their mind;
  • no longer requires the product;
  • orders the incorrect product;
  • finds another product or supplier;
  • finds a cheaper price elsewhere; or
  • otherwise decides not to proceed with the purchase.

A request to cancel or amend an order before dispatch may be considered by Dominator Sports at our discretion, but we are not required to approve a change-of-mind cancellation.

Where we agree to a cancellation or amendment, Dominator Sports may deduct reasonable and irrecoverable costs already incurred in connection with the order, including where applicable:

  • payment processing costs;
  • warehouse handling;
  • pick and pack charges;
  • freight booking costs;
  • special-order costs; and
  • other reasonable costs directly associated with the order.

Nothing in this section affects any cancellation, refund or other right available under the Australian Consumer Law.

7. No Change-of-Mind Returns

Dominator Sports does not offer refunds, returns, exchanges or credits simply because a Customer:

  • changes their mind;
  • no longer wants or requires the product;
  • orders an incorrect product, size or configuration;
  • finds the product cheaper elsewhere; or
  • later decides the product is unsuitable for a reason that does not amount to a failure under the Australian Consumer Law.

There is no general 7-day return period.

Dominator Sports may agree to a change-of-mind return in exceptional circumstances at our discretion.

If we agree to accept such a return, reasonable freight, handling, warehousing or restocking costs may apply and will be advised to the Customer.

This section does not apply where the Customer is exercising a right under the Australian Consumer Law.

8. Pricing and Freight Calculation Errors

Dominator Sports takes reasonable care to ensure website prices and shipping calculations are correct.

However, genuine system, configuration or freight-calculation errors may occasionally occur.

For example, an incorrect freight class may be applied to a large basketball hoop or a lower-cost shipping method may incorrectly become available when multiple products are purchased together.

Where a genuine or obvious error is identified before dispatch, Dominator Sports may place the order temporarily on hold and contact the Customer.

Dominator Sports will not charge an additional amount without the Customer's agreement.

The Customer may then:

  • agree to the corrected price or freight amount; or
  • cancel the affected order and receive a refund of the amount paid for that order.

This section does not give Dominator Sports a general right to change an agreed price after an order has been accepted.

9. Shipping and Delivery

All delivery timeframes provided by Dominator Sports or a freight carrier are estimates unless expressly agreed otherwise.

Large Dominator products are generally delivered through commercial freight carriers rather than standard parcel couriers.

Customers must provide accurate delivery information, including where applicable:

  • full delivery address;
  • contact name;
  • telephone number;
  • whether the property is residential or commercial;
  • whether a forklift is available;
  • access restrictions;
  • unloading requirements; and
  • any other information reasonably required for delivery.

Additional carrier charges resulting from incorrect or incomplete information supplied by the Customer may be charged to the Customer where reasonable.

These may include:

  • residential delivery surcharges;
  • tailgate charges;
  • re-delivery charges;
  • waiting time;
  • depot fees;
  • storage;
  • address-change charges; or
  • additional handling fees.

Shipping addresses generally cannot be changed once an order has been dispatched.

If a carrier permits an address change while goods are in transit, additional charges may apply.

10. Delivery Method and Access

Unless otherwise agreed, large freight deliveries are generally curbside deliveries only.

This means the carrier will unload the goods at the nearest reasonably accessible curb, driveway or delivery area.

Delivery does not include:

  • assembly;
  • installation;
  • carrying goods through the property;
  • moving goods to the installation location; or
  • disposal of packaging.

Customers are responsible for ensuring that the delivery location is reasonably accessible to the freight vehicle.

Where access is restricted because of steep driveways, narrow streets, overhanging trees, weight restrictions, insufficient turning area or other site conditions, delivery arrangements may need to be changed.

In some circumstances the Customer may be required to collect the goods from the nearest suitable freight depot.

11. Commercial and Residential Freight

Where delivery is quoted on the basis that the receiving location is a commercial premises with suitable unloading equipment, the Customer must ensure the required equipment is available when delivery occurs.

This may include a forklift or other appropriate unloading facility.

Residential deliveries may require:

  • tailgate unloading;
  • pallet trolley services;
  • additional handling; or
  • other specialised delivery arrangements.

A residential address does not become a commercial freight location solely because a business is registered at that address.

The freight carrier's classification and access requirements will apply.

12. Delivery Appointments and Receipt of Goods

Where applicable, the freight carrier may contact the Customer directly to arrange delivery.

Delivery times are generally determined by the carrier and may vary.

A signature may be required at delivery.

Goods will not ordinarily be left unattended unless authority to leave has been approved or arranged.

Where the Customer expressly provides authority to leave goods unattended, the Customer accepts the risks reasonably associated with leaving the goods at the nominated location after delivery, subject to any rights that cannot legally be excluded.

13. Inspection of Deliveries

Customers should check and count all packages against the consignment information when receiving their order.

Customers should inspect the goods as soon as reasonably possible following delivery, particularly:

  • glass backboards;
  • frames;
  • poles;
  • rims;
  • accessories; and
  • packaging showing signs of impact or damage.

If visible damage is identified, we strongly recommend that the Customer:

  • notes the damage on the delivery docket or electronic proof of delivery where possible;
  • photographs the packaging before opening it;
  • photographs the damaged product;
  • retains relevant packaging; and
  • contacts Dominator Sports as soon as reasonably possible.

Noting visible damage at delivery assists Dominator Sports in investigating the matter and pursuing any applicable claim with the freight carrier.

Failure to note damage on the delivery docket does not exclude or restrict any rights the Customer may have under the Australian Consumer Law.

Customers should not refuse a delivery solely because visible damage is present unless instructed to do so by Dominator Sports.

Where appropriate, accept the delivery with the damage noted and contact us promptly.

14. Lost, Missing or Delayed Shipments

If an order is significantly delayed, missing or believed to be lost in transit, the Customer should contact Dominator Sports.

Where Dominator Sports arranged the freight, we will liaise with the freight carrier to investigate the shipment and work with the Customer to arrange an appropriate resolution.

Dominator Sports is not responsible for delays caused solely by circumstances outside our reasonable control, including:

  • freight-network delays;
  • severe weather;
  • road closures;
  • natural disasters;
  • industrial action;
  • port congestion;
  • government restrictions; or
  • other significant transport disruptions.

Nothing in this section excludes or restricts rights available under applicable law.

15. Undeliverable Orders

If an order cannot be delivered due to circumstances reasonably within the Customer's control, the Customer may be responsible for reasonable additional costs incurred.

These circumstances may include:

  • an incorrect or incomplete delivery address;
  • unsuitable site access;
  • failure to attend or receive a scheduled delivery;
  • failure to provide required unloading equipment;
  • refusal to accept a valid delivery;
  • failure to respond to reasonable carrier contact attempts; or
  • other Customer-caused delivery issues.

Additional costs may include:

  • return-to-depot fees;
  • return-to-sender freight;
  • storage;
  • handling;
  • re-delivery charges; and
  • other reasonable carrier or warehouse costs.

An undeliverable order does not automatically constitute a cancellation or return.

Where appropriate, Dominator Sports will contact the Customer to arrange collection or re-delivery.

If the Customer subsequently requests cancellation, the Cancellations and No Change-of-Mind Returns sections of these Terms will apply.

16. Risk

Where Dominator Sports arranges delivery, risk in the products generally passes to the Customer once the products have been delivered to the nominated delivery location, subject to applicable law.

Where the Customer collects the products, or independently arranges their own freight carrier, risk generally passes when the goods are collected from Dominator Sports or our warehouse.

This section does not exclude any responsibility that Dominator Sports cannot lawfully exclude.

17. Faulty, Defective, Damaged or Incorrect Products

Where a product fails to meet a consumer guarantee under the Australian Consumer Law, the Customer may be entitled to a repair, replacement, refund or other remedy depending on the nature and seriousness of the failure.

Dominator Sports may reasonably request photographs, information or inspection of a product before determining the appropriate remedy.

Where required by law, Dominator Sports will bear reasonable collection, return or transportation costs associated with an eligible claim.

Change-of-mind restrictions, discretionary restocking fees or original packaging conditions do not override rights relating to faulty or non-compliant goods.

18. Installation

Unless expressly included in a written quotation or order confirmation, purchase of a Dominator product does not include installation.

Many Dominator products require specific:

  • concrete footings;
  • anchor systems;
  • sleeves;
  • fixing methods;
  • mounting hardware; or
  • electrical requirements.

The Customer is responsible for ensuring that:

  • Dominator installation instructions are followed;
  • the correct anchor kit, sleeves or mounting system is used;
  • concrete footings and slabs are suitable;
  • concrete is allowed to cure appropriately;
  • underground services are identified before excavation;
  • suitable installation access is available;
  • applicable permits or approvals are obtained where required; and
  • installation complies with applicable laws and site requirements.

Customers should provide applicable Dominator footing, engineering and installation information to their builder, concreter or installer before construction or concrete works commence.

19. Independent Installers

Dominator Sports may provide customers with contact details for installers, concreters, electricians or other contractors familiar with our products.

Unless Dominator Sports expressly contracts with the Customer to provide the installation itself, these contractors operate independently.

Where the Customer contracts directly with an independent installer:

  • the installation agreement is between the Customer and installer;
  • the installer is responsible for their quotation and invoice;
  • the installer is responsible for their workmanship; and
  • Dominator Sports is not responsible for the independent contractor's acts or omissions to the extent permitted by law.

Where Dominator Sports contracts directly to provide installation services, applicable legal rights and consumer guarantees relating to those services continue to apply.

20. Site Conditions

Dominator Sports cannot control site-specific conditions including:

  • soil conditions;
  • existing concrete quality;
  • underground services;
  • drainage;
  • structural conditions;
  • site access;
  • surrounding buildings or structures; or
  • workmanship performed by third parties.

Unless Dominator Sports expressly agrees in writing to assess or accept responsibility for a particular site condition, responsibility for determining the site's suitability remains with the Customer and relevant contractors.

Nothing in this section excludes responsibility that cannot legally be excluded.

21. Product Safety and Proper Use

Customers must comply with all applicable:

  • installation instructions;
  • operating instructions;
  • warning labels;
  • safety stickers;
  • maintenance information; and
  • safety requirements supplied with the product.

Dominator products must not be climbed on, swung from or used contrary to the supplied safety instructions.

Hanging or swinging from a basketball rim, backboard, support structure or basketball system is not recommended or permitted under Dominator Sports safety instructions.

Children should be appropriately supervised when using sporting equipment.

Safety labels and warning notices must not be intentionally removed, obscured or damaged.

22. Maintenance and Inspection

Sporting equipment installed outdoors may be exposed to weather, environmental conditions and repeated use.

Customers should periodically inspect equipment for:

  • loose fasteners;
  • abnormal movement;
  • damaged structural components;
  • damaged rims;
  • damaged backboards;
  • damaged nets;
  • deterioration of footings or fixings;
  • corrosion of non-aluminium components;
  • damage to electrical components; or
  • any other condition that may affect safe operation.

Products showing signs of structural or safety-related damage should not be used until appropriately assessed.

23. Dominator Voluntary Warranties

Certain Dominator products are supplied with voluntary warranties in addition to rights under the Australian Consumer Law.

Where a product is advertised as having a Limited Lifetime Frame Warranty, that warranty applies only to the structural frame components identified in the applicable warranty terms.

A Limited Lifetime Frame Warranty does not mean that every component of the product is covered for life.

Different warranty periods may apply to:

  • backboards;
  • rims;
  • nets;
  • hardware;
  • coatings;
  • moving components;
  • electrical products;
  • LED fixtures;
  • drivers;
  • accessories; and
  • replacement parts.

The voluntary warranty applying to a product is the warranty supplied or published for that product.

All Dominator voluntary warranties operate in addition to rights under the Australian Consumer Law.

24. Residential, School, Community and Commercial Use

Dominator Sports products may be supplied for:

  • residential;
  • school;
  • sporting club;
  • community;
  • government; and
  • commercial applications,

where the relevant product is suitable for that use.

The fact that a product is installed at a school, club, business or commercial venue does not by itself remove statutory rights available to the purchaser.

Any specific voluntary warranty conditions applying to particular usage types will be stated in the applicable warranty document.

25. Product Selection and Advice

Dominator Sports may provide product recommendations based on information supplied by the Customer.

The Customer should provide accurate information about:

  • intended use;
  • installation location;
  • surface or footing;
  • environmental conditions;
  • users;
  • project requirements; and
  • any relevant construction requirements.

Where a project has particular engineering, sporting-standard, planning, electrical, safety or construction requirements, the Customer is responsible for confirming that the selected product satisfies those requirements unless Dominator Sports has expressly agreed in writing to undertake that assessment.

Nothing in this section excludes liability for representations or advice where responsibility cannot lawfully be excluded.

26. Replacement Parts

Dominator replacement parts are intended for the compatible Dominator products identified by us.

Unless expressly stated otherwise, Dominator replacement components are not represented as universal products suitable for equipment manufactured by other brands.

Customers should confirm compatibility before ordering.

Where a Customer incorrectly selects a replacement part, this will generally be treated as an incorrect-selection or change-of-mind issue unless Dominator Sports caused the incorrect selection.

27. Lighting and Electrical Products

Electrical products must be installed and connected in accordance with applicable Australian electrical requirements.

Where required by law, installation must be performed by a suitably licensed electrician.

Customers must comply with all mounting, electrical and installation instructions supplied with Dominator lighting products.

To the extent permitted by law, Dominator Sports is not responsible for damage caused by:

  • unauthorised electrical work;
  • incorrect voltage;
  • improper electrical installation;
  • unauthorised modifications; or
  • use outside the published product specifications.

28. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies:

  • the Australian Consumer Law;
  • any consumer guarantee;
  • any statutory right or remedy; or
  • any liability that cannot legally be excluded.

To the maximum extent permitted by law, Dominator Sports is not responsible for loss or damage caused by:

  • misuse or abuse;
  • failure to follow safety instructions;
  • failure to follow installation instructions;
  • unauthorised modification;
  • incorrect installation by a third party;
  • unsuitable foundations;
  • unsuitable site conditions;
  • failure to maintain or inspect the product;
  • damage caused by the Customer or another person after delivery; or
  • use outside published specifications.

Nothing in this section affects any right to recover loss or damage where Australian law provides that right.

29. Events Outside Our Reasonable Control

Dominator Sports is not responsible for failure or delay caused solely by circumstances outside our reasonable control.

These circumstances may include:

  • natural disasters;
  • major transport disruptions;
  • port congestion;
  • industrial disputes;
  • severe weather;
  • government restrictions;
  • international freight disruption; or
  • other comparable events.

We will take reasonable steps to minimise disruption and communicate with affected Customers where appropriate.

This section does not allow Dominator Sports to retain payment indefinitely where the Customer is legally entitled to a refund or other remedy.

30. Promotions and Discount Codes

Promotional offers, competitions and discount codes may be subject to separate conditions.

Unless otherwise stated:

  • discounts cannot be combined;
  • discounts cannot be applied retrospectively;
  • discounts generally do not apply to freight; and
  • promotional offers may be limited by time, quantity or stock availability.

Nothing in promotional terms affects statutory consumer rights.

31. Intellectual Property

Dominator Sports trademarks, branding, photographs, drawings, product information, manuals, website material and other intellectual property remain the property of their respective owners.

Purchasing a Dominator product does not transfer intellectual property rights in the product design, documentation, trademarks or branding.

Dominator proprietary material must not be reproduced for commercial use without permission.

32. Dealers, Trade and Commercial Customers

Separate terms may apply to approved:

  • dealers;
  • resellers;
  • builders;
  • trade customers;
  • distributors;
  • commercial projects; or
  • bulk purchases.

Where a separate written commercial agreement has been entered into, that agreement will apply to the extent of any inconsistency with these website Terms.

Nothing in a separate agreement excludes rights that cannot legally be excluded.

33. Privacy

Personal information supplied to Dominator Sports is handled in accordance with our Privacy Policy and applicable law.

We may provide information reasonably necessary to fulfil an order to service providers including:

  • freight carriers;
  • warehouses;
  • installers;
  • payment providers;
  • contractors; and
  • other service providers involved in processing or delivering an order.

34. Complaints and Disputes

If a Customer has a problem with a product, order or service, we encourage them to contact Dominator Sports first so we have an opportunity to investigate and attempt to resolve the matter.

Nothing in these Terms:

  • requires a Customer to submit to binding arbitration;
  • prevents a Customer from exercising rights through a court or tribunal; or
  • restricts access to a consumer regulator or other process available under Australian law.

35. Changes to These Terms

Dominator Sports may update these Terms from time to time.

The Terms applying to an order are generally those in effect when that order was placed.

A later change to these Terms will not retrospectively alter an existing order unless:

  • Dominator Sports and the Customer agree; or
  • the change is required by law.

36. Entire Agreement

These Terms, together with any applicable:

  • quotation;
  • order confirmation;
  • invoice;
  • product information;
  • shipping policy;
  • warranty;
  • installation information; and
  • separately agreed written terms,

form the agreement relating to the purchase.

Nothing in this section excludes or restricts a representation, statutory guarantee or other legal right that cannot lawfully be excluded.

37. No Waiver

If Dominator Sports does not immediately enforce a right under these Terms, this does not automatically mean we have waived that right.

38. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

39. Governing Law

These Terms are governed by the laws of Victoria, Australia and applicable Commonwealth laws, including the Australian Consumer Law.

The parties submit to courts and tribunals having jurisdiction under applicable Australian law.

Nothing in this section prevents a consumer from exercising a right available to them in another Australian jurisdiction where applicable law allows it.
